A Notary Public is an official of integrity appointed by state government – typically by the secretary of state – to serve the public as an impartial witness in performing a variety of official fraud-deterrent acts related to the signing of important documents.

A Notary’s duty is to screen the signers of important documents for their true identity, their willingness to sign without duress or intimidation, and their awareness of the contents of the document or transaction.

 

To ensure the identity of the signer, the Link notary will ask to see a current driver’s license or, in the case of a non-licensed co-signer, an identification document or card with a photograph, physical description, and signature (e.g. government ID). An Affidavit of Identity is filled out and notarized for each signer of your documents. These affidavits are returned with your documents to be filed with the documentation.

This depends on the document. Certain affidavits, deeds and powers of attorney may not be legally binding unless they are properly notarized. Some states may require notarization of certain DMV documents or contracts. Please check with your state DMV for regulations and requirements. Private entities and individuals may require notarization of their documents for verification purposes and to prevent fraud.

A notarization alone does not make a document “legal”. A notarization typically means the signer acknowledged to the notary that he or she signed the document and affirmed their identity as it relates to their transaction.
